Tellura

1. Acceptance of Terms

By accessing or using Tellura ("the Service"), operated by ZVN DEV, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Tellura is an AI visibility monitoring platform that tracks how brands are mentioned and positioned across AI language model responses. The Service includes AI query execution, response analysis, competitor tracking, reporting, and related features.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. You must notify us immediately of any unauthorized access. One person may maintain multiple workspaces.

4. Subscription Plans & Billing

Plans: The Service offers tiered subscription plans (Essentials, Starter, Growth, Enterprise) with varying credit allocations, feature access, and resource limits.

Credits: Credits are consumed when AI queries are executed. Different models consume different amounts of credits based on actual API costs. Unused credits do not roll over between billing periods.

Credit Add-Ons: Additional credits may be purchased as one-time packs at published rates.

Billing: Subscriptions are billed monthly via Stripe. You authorize recurring charges to your payment method. You may cancel at any time; access continues until the end of the current billing period.

Refunds: We offer a 14-day money-back guarantee for new subscriptions. After 14 days, no refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to reverse-engineer, decompile, or extract source code
Abuse AI platform rate limits or manipulate credit tracking
Share account credentials with unauthorized parties
Use the Service to harass, defame, or harm others
Circumvent plan restrictions or feature gating

6. Intellectual Property

Your Data: You retain ownership of all data you input into the Service (business information, prompts, knowledge base facts). We claim no ownership over your content.

AI Responses: AI-generated responses are provided by third-party AI platforms. Ownership and usage rights are governed by each platform's terms of service.

Our Service: Tellura's software, design, analysis algorithms, and scoring methodologies are proprietary to ZVN DEV.

7. Third-Party Services

The Service integrates with third-party AI platforms (OpenAI, Anthropic, Google, Perplexity, xAI) and other services (Stripe, Cloudflare). Your use of these services is subject to their respective terms. We are not responsible for third-party service availability or changes.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. AI platform outages, maintenance windows, and force majeure events may affect service availability. We will provide reasonable notice of planned maintenance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, ZVN DEV shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time via Settings. Upon termination, your data will be deleted within 30 days unless legally required to retain it.

12. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email to registered users. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of Rhode Island.
